EXILED: 10SBoulevard Blogger Evicted For Hyper Local News Site

 Evicted and exiled, that's the consequence of blogging at 10SBoulevard.com and bringing the city's attention to an unsafe rental property. Loyal readers have expressed shock and dismay that hyper-local coverage of news in the Boulevard area has reduced to a trickle over the past week as a result of the eviction of the last 10SBoulevard.com blogger.

The Past
It was September of 2008 when my landlord discovered our community news site and began a campaign of harassment to force me to find a new home. The property owner made numerous attempts to unilaterally void my lease for reasons irrelevant to our rental agreement , he neglected to make repairs and diminished service to my apartment, and he scrawled bizarre notes for the purpose of harassment on the back of deposited checks.

With all of this threatening behavior I realized this guy has limited interest in keeping up his property and that his motive was to silence my reporting of news of community interest, ie. public safety issues. He did not want attention drawn to dangerous conditions that plagued his aging buildings . After this realization I documented all of the questionable conditions on the property and notified inspectors with the Richmond City Division of Code Enforcement.

In October of 2008 Code enforcement representatives found that the wobbly four story fire escapes on the building were in serious states of decay and no longer safe for residents to utilize much less first responders in the event of an emergency. According to the inspector one of these fire escapes was supported by little more than a bottle jack (similar to an automobile tire jack).

The Present
The property owner was ordered to replace the dangerous structures at 10 S Boulevard by city officials in the fall of 2008 and it was only in the spring of 2009 after threats from those same city officials did the landlord pursue construction. According to placards left on the building by Code Enforcement the property owner has until July 30 to finish the project or face fines, criminal prosecution and condemnation of the top floor of the building. As of this writing on July 28th the fire escapes remain in states of disrepair with lumber and debris strewn about the area.

My Eviction
Since the harassment and threats commenced I sent my monthly rent check of $1,050 via Certified US mail. A total of 8 checks were mailed certified and received by the property owner. In June of 2009 I sent my check on time via first class mail thinking "during these difficult economic times who would turn away a $1,050 check?" Answer: My Landlord.

On June 12 my landlord filed with Richmond General District Courts for possession of my apartment claiming that rent for the month of June was not received. I went to court and explained that my landlord failed to notify me of non-receipt of rent with a legally mandated 5 Day Pay or Quit Notice. Without hearing more on the case and its retaliatory nature the judge awarded possession of my apartment unit to the landlord effectively allowing eviction.

The Future
For now I am blogging in exile from North Boulevard until I begin a new lease on South Boulevard in August. Many have asked what will become of this site and will you continue writing? Much has changed since 10SBoulevard.com began as an organizing tool and outlet for news among tenants in one building over a very small geographic area.

Our audience is now shockingly large and our scope of coverage has increased tremendously. In the next week a new site will be launched that embodies the full scope of Boulevard, Carytown and Museum District life. We'll cover the same great stories with the same excitement, enthusiasm and sensationalism as 10SBoulevard.com

As to 10 S Boulevard the property, I am glad that this site and my efforts with the city compelled the landlord to remedy dangerous conditions. Instead of facing a future tragedy with "well we all knew it would collapse one day" I can take comfort in knowing at least one property on the Boulevard is a safer place to call home. Isn't that what matters the most?

Richmond Slumlords

As a previous poster related, I also had problems with River City Real Estate. They presented us with a notice of non renewal of our lease for "multiple late payments of rent." Of course, I have a record of on time payments, barring one. I got notes and harassing fliers posted on my door in the middle of the night. I was threatened with harm on the internet. After I moved out, I had my deposit taken and informed that I owed about a thousand dollars (going to court). All of this for doing the same thing you did...taking my and other tenants complaints into a public forum. Virginia law is stacked high against the tenant, and was made even harsher with the new additions to the VRLTA. Keep up the good work, Peter. Perhaps eventually we could collaborate on something to bring awareness of tenant situations into the open? As long as these people can get away with it, they will. Best of luck to you.

As a former renter in 10S I

As a former renter in 10S I can attest to everything that Peter says. There have been so many incidences that have occured that the Hollister's were in the wrong for and did NOTHING about it. One instance was when the Hollister's work latter that they left on top of the garage going up to the roof had been there for WEEKS and it fell on a tenants car. The Hollister's said it was not their fault, even though they cleary were irresponsible and neglectful in leaving a latter up for weeks. The outcome was the tenant had to pay $1,000 out of pocket to fix their car that was parked in a PAID parking spot behind the building. The Hollister's claimed it was not covered under their insurance...UNBELIEVABLE! They would also FREEZE us out in the winter because they paid for the "heat" (it was radiator heat and they controlled it and there were times the temperture was recorded in apts in the 50s and 60s DURING THE WINTER) They are awful landlords and the best thing that ever happened was when our lease ran out. Oh not to mention when we moved out they gave us a moving out checklist. On this it said we had to clean the radiators with radiator brushes that THEY would provide. However, they never brought them to us...we waited, they never came. I guess it was their way of being able to charge us so they couldn't refund our whole deposit! OH and the front balcony, which we NEVER USED because it was unsafe. It leaned and wobbled when you went out on it so we did not ever use it, they charged us for not having it cleaned..even though I swept it before we left, oh that's right it rained the whole weekend we moved out so they charged us because there were puddles on the balcony and leaves that had FALLEN ON IT FROM THE TREE! They are absolutely ridiculous and I would gladly back Peter up in court. I am pretty sure he knows who this is and knows how to contact me! Oh one last example, our front door to our apartment only had one lock on it, which was the same key to get in the front door, which means YEP ANYONE that ever lived in the building could have came in! We even had them come check it so we could get our locks changed and they refused!!!!!!!!!!!

I wanted to also add that I do know how to spell ladder, I spelled it latter kind of like a pun because any letter you ever received from the Hollister's had tons of mispelled words, or words used in the wrong context....I realized I didn't explain that in my first post!

Peter, I too have dealt with a landlord that has done some of the things you have mentioned and then some (delayed or refusal of repairs, shotty fixes for major issues-plumbing, coming into my apartment unannounced only for me to come home and see my door open and workmen in my apartment, etc). I can understand your frustration and I don't think you did anything wrong by bringing these concerns to light. Quite a few landlords in the Richmond area take advantage of their tenants and get away with things you can't even imagine. As for the Holisters, there time will come.

It's such a shame that things have to come to this. What has happened with just common deciency? So many things all revolve around money-sad to say. If you can't be a good landlord, don't be one!!!!!! Sorry you are going thru this.

Outrage!

Peter, I've met u through a friend and e-mailed u about my own issues w/ my own former landlord, River City Real Estate. Without saying much more I'm sure this name brings irritation and outrage to many Richmonders as well. In response to the first comment, this is definitely happening all over Richmond, and it is disgusting to think about the money they are raking in. I'm happy to say I have moved as of July 18th and haven't been happier in ages, and can actually sleep in peace and comfort. I'm upset that the judge didn't hear your case and I'm curious the reasoning. well I will keep this brief - thank you for speaking out!

You have to wonder how many

You have to wonder how many other properties are like this around the city. AND how many other landlords are like this. AND how worthless district court judges are. The one awful thing about renting in Richmond... RENTING.

I was lucky to find Pierce Arrow first when apartment hunting in Richmond. I will be sure to not only not recommend Hollister properties to anyone who asks, but go so far as to explicitly advise apartment hunters against renting with Hollister, in light of your site. This site has been a community gem. I look forward to its bigger and better evolution.

As a previous Hollister tenant, I completely agree about Pierce Arrow. They're always so responsive and keep my building in great condition. It's been a completely different experience renting from them.

River City Slumlords

It seems that RVA has a slumlord problem. Hollister's behavior, indeed, sounds much like that of River City Real Estate. I am now free of RCRE. The company is so vile that I had to leave. The rent was cheap, but it wasn't worth it. In fact, living at a River City Real Estate apartment will cost you more than other apartments of the same or lesser rent because RCRE will rip you off. They refuse to return deposits (with the help of the company's $300 "refurbishment" fee). They charge for simple maintenance. They threaten to fine people $200 for leaving any items on balconies. Check out the site www.rcrava.org. It's the page for the River City Residents Association, which is made up of people who've been burned by their landlord. It'd be great if residents could present a united front against slumlord practices. Something needs to change at the state-wide/legal/legislative level. It's getting to the point where landlords are driving people out of the city.

If what you say about the eviction is true you can contest it.... and should. I'm a landlord on the Boulevard and he did not follow the law.
